Terms of service
Terms and Conditions — Bakos Men
1. Definitions
The general terms and conditions set out below apply to all sales of goods by Bakos and its partners, through the online store bakosmen.ro, to the Buyer, and may be modified at any time by Bakos without prior notice.
The following terms shall mean:
-
Buyer – an individual / legal entity or other legal entity that places an Order.
-
Seller – Bakos, trading as SC. Rodies Fashion SRL, having its registered office at 187 Ion Mihalache Boulevard, ground floor, Right Commercial Space A, Block 4, CUI 48319196, Trade Register registration number J40/10881/2023.
-
Goods – any product, including the documents and services mentioned in the Order, to be provided by the Seller to the Buyer.
-

-
Contract – an Order confirmed by the Seller.
-

⸻
2. Contractual Documents
By placing an electronic Order on bakosmen.ro, the Buyer agrees to the means of communication (email, phone) through which the Seller conducts its operations. The Order is made up of the following documents:
-
The Order (together with clear indications of delivery and billing details) and its specific conditions.
-
Terms and Conditions.
If the Seller confirms the Order, this implies full acceptance of the Order's terms. Acceptance of the Order by the Seller is considered complete once there is an electronic confirmation (email) from the Seller to the Buyer, without requiring an acknowledgment of receipt from the Buyer. The Seller never considers an unconfirmed order to have the value of a Contract.
Order confirmation is done electronically (email). Product prices in an order are valid for 3 business days from the date the order is registered. These general terms and conditions of sale form the basis of the Contract thus concluded.
⸻
3. Seller's Obligations
The Seller will use its professional and technical knowledge to achieve the result specified in the Order and will deliver Goods that meet the requirements and specifications expressed by the Buyer in the Order.
Information presented on the Seller's site(s) is for informational purposes and may be changed by the Seller without prior notice. Product descriptions may be incomplete, but the Seller makes efforts to present the most relevant information so that the product can be used for the purpose for which it was purchased.
⸻
4. Intellectual and Industrial Property Rights
The User/Buyer understands the intellectual property rights involved and will not disclose to any third party or make public any of the information received from the Seller.
All drawings, graphic and design elements appearing on the site, the site name, and all graphic symbols are trademarks owned by Bakos and may not be taken, copied, or used without the owner's written consent.
All content elements — such as descriptions, drawings, graphic and design elements appearing on the site, including but not limited to logos, stylized representations, commercial symbols, static images, dynamic images, text and/or multimedia content presented on the site — are the exclusive property of Bakos, which reserves all rights obtained in this regard, directly or indirectly, through usage and/or publication licenses.
The User/Buyer is not permitted to copy, distribute, publish, transfer to third parties, modify and/or otherwise alter, use, link to, display, or include any of the above content elements in any context other than the one originally intended by Bakos, to include any content element outside the Site, to remove copyright notices belonging to Bakos on content elements, or to participate in the transfer, sale, or distribution of materials produced by reproducing, modifying, or displaying content elements, except with Bakos's express written consent.
⸻
5. Rights over the Site's Content
The entire content of the site and its graphic elements, including but not limited to all text content, as well as the technical sources of all present and future services and features — except where another owner is expressly stated — the page sources, and any other material transmitted in any form to and from Users (through direct viewing on the site, newsletters, etc.) belong to Bakos.
The site's content, regardless of where on the site it is located or its type, may be used exclusively for personal purposes. Any use of content by third parties for purposes other than personal use may only be done with Bakos's prior, express, written consent. Users agree to respect all copyright and related rights, and any other intellectual property rights that the Site Administrator and its partners hold over/in connection with bakosmen.ro.
Bakos reserves the right to take legal action against any person and/or entity that violates the above provisions in any way. Requests to use the site's content for any purpose other than personal use may be made by email to office@bakosmen.ro, marked "Attn: Agency".
Any person who transmits or publishes, in any way, information or materials to the site takes on the obligation not to infringe in any way the copyright that a third party might claim in connection with the materials and information transmitted to the site, and persons who send information or materials in any way understand and accept that violating this obligation in any way cannot in any way engage Bakos's liability, but only the liability of those persons.
Bakos may run advertising campaigns and/or promotions in any section of the site at any time, without this requiring the consent of Site Users. The spaces and scale of advertising campaigns and promotions do not require the consent of Site Users and may be changed at any time without prior notice.
Bakos assumes no responsibility for damages or losses resulting from advertising campaigns or promotions organized on the site, other than those organized strictly on the site.

9. Invoicing and Payments
The price, payment method, and payment term are specified in the Order. The Seller will issue an invoice to the Buyer for the Goods delivered; it is the Buyer's obligation to provide all information required to issue the invoice in accordance with applicable law.
To ensure correct communication of the invoice related to the Order, the Buyer is responsible for updating their Account details whenever necessary and for accessing the information and documents related to each Order in their Account.
By submitting the Order, the Buyer agrees to receive invoices in electronic format as well, via email, at the email address indicated in their Account.
⸻
10. Responsibilities
-
The Seller undertakes to ship the Goods and Services to the Buyer via door-to-door courier.
-
The Seller is released from the risks and responsibilities associated with the Goods and Services at the moment they are handed over to the domestic courier company the Seller works with, or to the Buyer's representative.
-
The Seller will ensure proper packaging of the Goods and Services and will ensure that accompanying documents are provided.
-
The Seller cannot be held responsible for any damages that the Buyer or any third party may suffer as a result of the Seller fulfilling any of its obligations under the Order, or for damages resulting from the use of the Goods after delivery, and in particular for the loss of products. The Seller will be liable if its subcontractors and/or partners of any kind involved in fulfilling the Order fail to meet any of their contractual obligations.
-
The Seller assumes no responsibility for product descriptions presented on the site. Images on the site are provided as examples, and delivered products may differ in any way from the images and descriptions shown on the site, due to changes in features and design without prior notice. The Seller reserves the right to add to and modify any information on the site without prior notice.
-
The Seller does not guarantee the stock availability of displayed products, and therefore has the right not to deliver a given order, in part or in full, if certain products are no longer part of the current offer or are unavailable.
-
If prices or other product details have been displayed incorrectly, including due to data-entry errors in the database, the Seller reserves the right to cancel delivery of that product and to notify the customer as soon as possible about the error, if delivery has not yet taken place.
-
The Seller is not liable for damages caused by the site's malfunction, nor for damages resulting from the inability to access certain links published on the site.
-
The maximum value of the Seller's obligations toward any customer, in the case of non-delivery or improper delivery, is the amount received by the Seller from that customer.
-
Products sold on the site are intended for personal use, and their resale is strictly prohibited, in accordance with the Fiscal Code.
⸻
11. Product Delivery
Delivery is not free and is carried out via express courier, as described in the "Delivery" section.
Our products are sometimes made to order, which means production and delivery time can take up to 14 business days from the day the order is processed.
Orders are processed as soon as possible after being placed, within the Monday–Friday 10:00 AM–6:00 PM window. Orders placed outside business hours (Monday–Friday 10:00 AM–6:00 PM) or on weekends will be processed on the next business day. During holidays and sale periods, delivery times may be extended.
If a package cannot be delivered (the recipient does not answer, the address provided is incorrect, etc.), you will be contacted by phone by the courier. If the recipient cannot be reached, packages remain with the local courier for 7 days, after which they are returned to the Sender.
We are not liable for delayed shipments, loss, destruction, damage, non-delivery, or misdelivery of a shipment or part thereof, when caused by the following situations/circumstances beyond our control, including but not limited to:
-
road blockages (fallen trees, rockfalls, chain collisions), landslides near the road;
-
bridge collapses, blocked mountain tunnels, train derailments near the road, natural blockages, unauthorized strikes, spontaneous regional unrest, weather conditions unfavorable to the planned route;
-
natural causes: earthquakes, cataclysms, devastating storms, tornadoes, wildfires, floods, river overflows, riverbed changes, etc.;
-
human causes: state of war, state of siege, forced nationalization (transfer into state ownership), revolutions, popular uprisings, etc.;
-
failure by suppliers and third parties to fulfill orders.
⸻
12. Acceptance
Acceptance occurs when the Goods conform to the technical specifications stated in the Order. If the Buyer discovers that the delivered Products do not conform to the technical specifications, the Seller will bring the Products into conformity. Additionally, for products sold and delivered by Bakos, the Buyer is entitled to return products within 14 days.
⸻
13. Transfer of Ownership
Ownership of the Goods is transferred upon delivery, after payment has been made by the Buyer, at the location indicated in the order (delivery being understood as signing the courier's proof-of-delivery document, or signing to acknowledge receipt on the fiscal invoice in the case of deliveries made by the Seller's own staff). In the case of courier delivery, the courier is not authorized by the Seller to allow the Buyer to open packages before signing for delivery, but only after signing for delivery and paying any amount due.
⸻
14. Product Returns
The Buyer may request the return of products in the following situations:
-
Packages show severe damage.
-
Products were delivered/invoiced incorrectly. Delivery of products other than those ordered must be reported immediately. The Buyer may request a return for replacement, and if the product is no longer in stock, may choose replacement or a full refund of its value. If a replacement with a higher-value product is agreed, the Buyer will pay the difference; if the value is lower, the Buyer will receive a partial refund up to the value of the replacement product. Return and shipping costs for the replacement product, if applicable, are borne by the customer.
-
Products show manufacturing defects.
The Buyer has the right to notify the Seller in writing that they are canceling the purchase, without penalties and without stating a reason, within 14 days of receiving the product. Additionally, in accordance with Art. 7(1) of Government Ordinance 130/2000, the Buyer has the right to unilaterally terminate the distance contract, in writing, within 14 days of the date of receiving the product(s), without penalties and without stating any reason. In this case, the direct costs of returning the products will, by law, be borne by the Buyer.
Products must be returned in their original packaging, with the invoice attached, and must show no signs of physical wear or damage.
Personalized products cannot be returned. Please note that these products are made according to the configurations you specified, and therefore cannot be exchanged or returned.
If a replacement with a higher-value product is agreed, the Buyer will pay the difference; if the value is lower, the Buyer will receive a partial refund up to the value of the replacement product. Return and shipping costs for the replacement product, if applicable, are borne by the Buyer. If the products requested for return show damaged or incomplete packaging, signs of wear, scratches, or impact damage, we reserve the right to decide whether to accept the return or to withhold an amount, which will be communicated after assessing the damage.
In the case of exercising the legal right of return, the reimbursement of the product's value will be made by bank transfer to the account indicated by the Buyer, within a maximum of 14 days from receipt of the returned product.

15. Processing of Personal Data
To ensure that Site Users' right to personal data protection is respected, we have implemented specific protective measures, taking into account Romanian legislation as well as the requirements established by Regulation (EU) 2017/679 — applicable throughout the European Union starting May 25, 2018 (the "Regulation").
Personal data means any information by which you can be identified, in particular through an identifier such as a name, an identification number, location data, an online identifier, or one or more factors related to your physical, physiological, genetic, mental, economic, cultural, or social identity.
Our company takes all necessary measures to ensure your right to personal data protection is respected, and these terms constitute the notice required under Art. 13 or 14 of the Regulation, explaining why we collect your personal data, how we protect it, and what your rights are in connection with this data collection.
We encourage you to read this document carefully and to ask us for any additional information or clarification you consider necessary regarding its contents.
1) General Considerations Regarding Your Personal Data
In accordance with Regulation (EU) 2017/679, Bakos will manage, under secure conditions and only for the specified purposes, the personal data provided by Users. Through these Terms and Conditions, Users are informed that the personal data they provide will be processed for the purpose of optimally providing, by Bakos, internet services, the supply of goods and services, advertising, marketing and promotional services, and statistical services.
Bakos carries out the following processing operations: collecting, recording, organizing, storing, adapting, modifying, extracting, consulting, using, and, in some cases, transmitting to third parties — on the exclusive and regulated basis of a commercial contract that ensures the security and confidentiality of data and respect for the user's rights — the personal data of Site Users, in order to administer, maintain, improve, and obtain information about the services it offers, as well as to prevent errors and information leaks through its own IT network, or breaches of law or contractual terms.
The personal data to be collected may be used, including through automated profiling (for those Users who have given explicit consent), to personalize as much as possible the services offered to Users through the site, as well as for marketing purposes. Automated profiling will not target minors' data; their personal data is not processed for this purpose.
Personal data will be provided by Users, at their own discretion, at the time of creating a valid account on the site or subscribing to a service available on the site, in order to benefit from the services and products offered through it. When registering on the site, the User is asked for certain personal data, such as first and last name, gender, date of birth, email address, phone number, occupation, habits/preferences/behavior, and other personal information.
The User is solely responsible for all data provided at the time of creating their user account on the site. To confirm the data and account, the User will be notified at the email address given when the account was created. This confirmation email serves to prevent fraudulent actions by users who use other people's email addresses to create fake accounts. If you receive such a message without having registered yourself on the site, please send us an email at office@bakosmen.ro so we can delete that account within a maximum of 3 business days. The email will include, in PDF format, the version of this Contract in force.
The User's profile form contains fields that can be edited if the User wishes to modify or complete the data provided when creating the account.
The User is not required to provide this data; it is needed (i) to keep records of site usage and (ii) to optimally provide services through the site, to inform Users of promotional campaigns, for advertising purposes, for personalized marketing and advertising actions, and for User access to additional features. A User's refusal to provide the requested data results in non-participation in promotional actions organized through the site and non-use of additional features/services offered exclusively to Users with an account on this website.
The Website may still be used if the User decides not to create a profile by providing personal data, with the exceptions established under the Cookie Policy (an integral part of this Contract).
In accordance with Regulation (EU) 2017/679 and Law No. 677/2001, Users benefit from the right of access, the right to intervene regarding their data, the right not to be subject to an individual decision, and the right to go to court. Additionally, Users have the right to object to the processing of their personal data and to request its deletion.
To exercise these rights, Users may submit a written request by email to office@bakosmen.ro, marked "Personal Data Request".
The site commits not to send spam messages (commercial messages for which it does not have the User's prior explicit consent) and to undertake all accessible technical means to ensure the security and confidentiality of user data.
The site reserves the right to terminate, without prior notice, the accounts and access of members who violate the Terms and Conditions, who engage in proven fraudulent activities, defamation, or attacks on the security and confidentiality of information within the site or the company operating the site.

-
Order – an electronic document that serves as a form of communication between the Seller and the Buyer, whereby the Seller agrees to deliver the Goods and the Buyer agrees to receive those Goods and to pay for them.
-
Contract – an Order confirmed by the Seller.
-
Intellectual Property Rights – all intangible rights such as know-how, copyright and related rights, database rights, design rights, model rights, patents, registered trademarks, and domain name registrations for any of the above.
-
Site – the domain bakosmen.ro and its subdomains.
⸻
Accordingly, it is prohibited to copy, take, reproduce, publish, transmit, sell, or partially, fully, or modified-ly distribute the content of this site or any part thereof for purposes other than personal use, with the following exceptions:
-
It is permitted to reproduce (on non-commercial sites, forums, press articles, etc.) small excerpts from published articles (max. 400 characters), provided the source of the information is credited with a link, in the following form: (Source: site name – link to the site's content).
-
Links to bakosmen.ro are permitted, with the source credited after each link or at the end of the article, as follows: "Information courtesy of Bakos – link to the site's content".
⸻
6. Limitation of the Site Administrator's Liability

⸻
-
road blockages (fallen trees, rockfalls, chain collisions), landslides near the road;
-
bridge collapses, blocked mountain tunnels, train derailments near the road, natural blockages, unauthorized strikes, spontaneous regional unrest, weather conditions unfavorable to the planned route;
-
natural causes: earthquakes, cataclysms, devastating storms, tornadoes, wildfires, floods, river overflows, riverbed changes, etc.;
-
human causes: state of war, state of siege, forced nationalization (transfer into state ownership), revolutions, popular uprisings, etc.;
-
failure by suppliers and third parties to fulfill orders.
⸻
⸻
2) Personal Data We Collect, the Legal Bases for Collection, and the Purposes of Collection
Within the online communication relationship established between the site and the user, we collect and process your personal data; this collection and processing is necessary to provide informational and promotional content to the user, following the user's voluntary completion of personal data on the site, by accessing one or more of the following sections: account creation, account update, newsletter subscription, completing an online questionnaire, completing an online form — for obtaining personalized information or commercial benefits within campaigns promoted on the site.
The legal bases for collecting personal data on the site may be the following:
-
the data subject has given consent to the processing of personal data for one or more specific purposes;
-
processing is necessary for the performance of a contract to which the data subject is party, or to take steps at the data subject's request prior to entering into a contract;
-
processing is necessary for compliance with a legal obligation to which the controller is subject;
-
processing is necessary to protect the vital interests of the data subject or of another natural person;
-
processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;
-
processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.
